On Tuesday, September 3, Frank Baltimore, 36, of Newburgh was sentenced to 13 years in prison to be followed by five years of post-release supervision following his conviction in Orange County Court of criminal possession of a weapon in the second degree, the sole charge against him, Orange County District Attorney David M. Hoovler announced.

According to Hoovler’s announcement, on July 11, 2023, at around 1 a.m., in the area of Dubois Street in the City of Newburgh, Baltimore allegedly “made threats to individuals in the area and then discharged a loaded 9mm handgun five times in the direction of the individuals.” The rounds struck a vehicle in the area, but the people nearby were unharmed. Surveillance video of the incident, along with physical evidence collected, led law enforcement to identify Baltimore as the perpetrator, Hoovler explained. He reportedly told the police that the person in the video was him but claimed that the gun he used was a BB gun.

Hoovler thanked the City of Newburgh Police Department for their investigation, as well as the Orange County Sheriff’s Office who assisted by providing testimony at trial.

“The lengthy sentence imposed in this case was appropriate for this dangerous offender, whose indiscriminate possession and use of a firearm was as dangerous as it was criminal,” said Hoovler. “My office is committed to ensuring the safety of our communities by identifying and holding accountable those who illegally possess and use firearms. I commend the work of the City of Newburgh Police Department whose investigation led to the apprehension and conviction of this defendant.”
